Family law

Family law is a field of law that deals with marriage relationships and other family issues. Since family law comes under civil cases it is also governed by Muluki Civil Code, 2074. Legal and Works (LAW) has been practicing family law for more than two decades. While providing services to clients, we ensure that they receive the results and satisfaction that they desire and demand. Our attorneys are highly skilled and excellent at what they do. Our services regarding family law are listed below: 1. Court marriage (Part-3, Chapter 1 and 2 of Muluki Civil Code, 2074) Court marriage or marriage registration (also known as ‘Paper Marriage’) is a legal way to marry. The couple finds a court competent to hear the case and signs legal papers in front of a judge who records their marriage. Marriage Registration in Nepal is a common procedure which can be done by following specific processes and it is applicable for both Nepali Citizen and Foreigner. The requirements for court marriage are listed below: 1. Husband and wife must both be of legal age, which is 20 years old. 2. The husband and wife must consent to be married; that is, they must provide their free will without being under any form of coercion. 3. There is no relation between those who have been Restriction of the law. 4. The spouses shouldn't be wedded to any other person already. Required documentation: 1) 4 /4 Passport-sized image 2) Two witnesses, 3) Original citizenship and passport for both applicants and witnesses. 4) Certified paperwork for unmarried individuals from the appropriate ward office at their permanent residence. If a foreigner is unmarried and single, they must present a no-objection letter from their consulate, embassy, or authorized agency. 5) At least a 15-day temporary stay letter from the local ward office. (If your permanent district is different), foreigner additionally filing letter of temporary stay later from stay-based location ward office. 6) The foreigner presented a copy of the family law and marriage act, as well as translations in English and Nepali. Divorce (Part-3, Chapter 3 of Muluki Civil Code, 2074) The proper legal course of action for married couples who want to dissolve their marriage is to file for divorce. It is the act of ending a marriage in accordance with Nepali divorce law between the parties. The marriage is dissolved when the couple's relationship ends. Couples are permitted to remarry and maintain their single status once the court issues a divorce document. The National Civil Code 2074, Chapter 3 contains Nepal's divorce-related legislation. Registering a firm for Foreign Direct Investment (FDI) in Nepal entails numerous processes directed by the Foreign Investment and Technology Transfer Act (FITTA) of 2019. Name Registration: Reserve a distinctive business name with the Office of the Company Registrar (OCR). 2. Obtain approval for foreign investments. Submit an FDI proposal: Submit an FDI proposal to the Department of Industry (DOI) or the Investment Board Nepal (IBN), depending on the amount of the investment. The Department of Industry accepts investments up to NPR 6 billion. Investment Board Nepal accepts investments above NPR 6 billion. Required documents: a. A project report or business strategy. b.
